No, Daniel Vorcaro was not released after the 2026 elections

Posts claiming the ex-Banco Master owner walked free on 31 October recycle a November 2025 TV report; he has been in custody since March 2026.

Both fact-checkers say he remains in custody. Lupa notes his defense asked the Inter-American Commission on Human Rights for his release on 2 November, which only makes sense if he is still detained.

A reverse search by both outlets traced the footage to an SBT Notícias report aired on 29 November 2025, about his first release under precautionary measures such as an ankle monitor.

Both outlets report the March 2026 re-arrest and continued detention in Brasília, citing news reports and STF communications (Aos Fatos). They differ on some details of the facility and who ordered the arrest.

  • UnsupportedThe 2025 release was motivated by threats made by Vorcaro.1 / 2 sources

Aos Fatos says there is no evidence for this. The judge reportedly found the requirements for preventive detention were not met and that other measures sufficed.

Lupa says the decision rests with the Supreme Federal Court, which is handling the case, not the Presidency. This claim is implied by the posts' framing rather than quoted directly.

Analysis

Posts on WhatsApp, TikTok, Instagram and Facebook say that Daniel Vorcaro, the former controller of Banco Master, was freed on 31 October 2026, just after Brazil's presidential election. Two fact-checking outlets, Agência Lupa and Aos Fatos, say this is false. The footage comes from a different release, almost a year earlier.

What's being claimed

The viral message is short: a text overlay reading roughly "Vorcaro was released, 31/10/2026", attached to a video. One TikTok-style caption cited by Aos Fatos adds that he walked out the front door after a billion-dollar fraud. According to Aos Fatos, some posts also suggest the release was driven by threats from Vorcaro. Lupa reports that the old clips resurfaced after the election to criticize President Lula, re-elected with 64 million votes, which implies the government had a hand in any release.

What the evidence shows

Both outlets used reverse image search and traced the video to an SBT Notícias report aired on 29 November 2025. The report covered a decision by the Federal Regional Court of the 1st Region (TRF-1) to revoke his preventive detention and that of four other Banco Master executives, with conditions such as an ankle monitor. Aos Fatos names the judge, Solange Salgado, and says he was freed eleven days after his first arrest.

He was arrested again in March 2026. Aos Fatos dates it to 4 March, during a new phase of Operação Compliance Zero, which investigates suspected financial fraud linked to Banco Master. Lupa attributes the order to Supreme Court justice André Mendonça, acting on a Federal Police request. According to Aos Fatos, Mendonça later rejected a request for house arrest, citing risks to the investigation flagged by the police, and said plea-deal negotiations did not justify lifting the detention.

Current custody is supported by a further detail from Lupa: on 2 November his defense asked the Inter-American Commission on Human Rights to secure his release. That petition would be moot if he were already free. Lupa adds that the commission can ask for explanations and make recommendations but cannot order a release, and that release decisions belong to the Supreme Court, not the Presidency.

Aos Fatos found no evidence that the 2025 release was caused by threats from Vorcaro. It says the judge ruled that the legal requirements for preventive detention were not met.

How outlets covered it

The two pieces agree on the core facts. Lupa stresses the political angle (the election, Lula, who has the power to release) and the human-rights petition. Aos Fatos focuses on reach, saying the posts had at least 10,000 views on TikTok and 2,500 interactions on Instagram and Facebook by the afternoon of 3 November, with unmeasurable spread on WhatsApp, and on the legal chronology. Both describe their method: reverse search plus news and court records. Aos Fatos adds that the outlet Boatos also debunked the post.

The outlets differ on where he is held. Lupa says he was moved in June from the Federal Police headquarters in Brasília to the "Papudinha". Aos Fatos says he is in the Papuda penitentiary complex, then names the 19th Military Police Battalion ("Papudinha"). These are usually described as separate facilities, so the exact location is worth confirming.

What we still don't know

The central claim is settled: he was not released on 31 October 2026. Open questions concern the case itself. Neither article says how the investigation or any plea negotiations will end, or when the Supreme Court might revisit his detention. The commission has not yet ruled on the defense's request. The reach of the posts beyond Aos Fatos's figures, and who first spread the recycled video, are not established in these sources.
